Towong Shire Council gives notice under Section 206 and Schedule 10(3) of the Local Government Act 1989 that it intends to discontinue one section of unused road reserve adjoining Crown Allotment A32\PP5539 in Mitta Mitta, marked ‘hatched’ in the plan below.
The road discontinuance and land exchange of one section of unused road reserve to the adjoining landowner will remove the inconsistencies in the present road alignment for Wombat Gully Road, Mitta Mitta.
Council in return will receive one section of land, marked ‘cross-hatched’ in the plan below, from the adjoining landowner, to offset the value of the road reserve being disposed.
The proposal is that Council:
- In accordance with Section 206, Schedule 10, Clause 3 and Sections 207A(a) and 223 of the Local Government Act 1989 and Section 114 of the Local Government Act 2020, hereby commences the statutory process to give public notice of the intention of Council to discontinue one section of unused road reserve and a land exchange with the adjacent landowner at Crown Allotment A32\PP5539 in Mitta Mitta by private treaty for the 237 m2 section of unused road reserve shown on the attached road discontinuance and land exchange plan.
- The Chief Executive Officer be authorised to make the proposed road discontinuance and land exchange available for public inspection and invite public submissions.
Any person proposing to make any submission under Section 223 of the Local Government Act 1989 must do so by 5.00pm on Monday, 15 June 2026.
All submissions will be considered in accordance with Section 223 of the Local Government Act 1989.

Any person requesting to be heard in support of their submission is entitled to be heard before Council (or a committee established by Council for this purpose) or be represented by a person acting on their behalf and will be notified of the time and date of the hearing.
After considering all submissions, Council will decide whether to proceed with the proposal.
